Terms of sale

You should read these Terms carefully, print a copy for future reference and also read our Privacy policy which outlines how personal information You provide to Us will be used.

These Terms do not apply to any financial or insurance services/products on the Site. By placing an order You agree to be bound by these Terms.

The content of these Terms does not constitute an offer by Us to sell the Goods. Your request to purchase Goods from the Site represents an offer by You that We may accept or reject. If We accept Your offer these Terms will apply to Your purchase order.

We reserve the right to change these Terms at any time. Any such changes will take effect when posted on the Site.

Definitions

Certain words and phrases have special meanings when used in these Terms:

“Date of Delivery” means 2 days after the date the Goods have been despatched;
“Goods” means durable goods available for purchase on the Site;
“Personal Information” means the details provided by You on registration;
“Special Conditions” means certain terms and conditions which may be posted on the site from time to time and apply in respect of any of the Goods provided on the Site;
“Terms” means these Terms of sale;
“United Kingdom” means England, Wales, Scotland, Northern Ireland and the Channel Islands;
“We Us and Our” means U K Insurance Limited either alone or together with You, as the context requires.
“Site” means the website under the domain name Churchill.com and other associated URL sites displaying the Goods;
“Working Days” means any day other than weekends and public holidays;
“You and Your” means the person ordering Goods subject to these Terms.

Description and price of the Goods

The description and price of the Goods You order will be as shown on the Site at the time You place Your order. All Goods purchased are sold subject to any Special Conditions which may be posted on the Site from time to time. We reserve the right to refuse bulk orders or orders intended for commercial or resale purposes.

The postage cost for deliveries within the United Kingdom is included in the price. All prices are in English Pounds Sterling. Prices are inclusive of VAT.

Payment

Payment for the Goods can be made by any method indicated on the Site displaying the Goods at the time You place Your order. U K Insurance Limited cannot accept Your order until You have paid for it in full (including any applicable overseas delivery charges).

No contract exists between You and U K Insurance Limited for the sale of any Goods until U K Insurance Limited has received Your payment; accepted Your order and provided You with confirmation in writing to the address or email address You have given. Once U K Insurance Limited does so, there is a binding legal contract between You and U K Insurance Limited.

Goods are subject to availability. If the Goods You have ordered are not available in stock, U K Insurance Limited will inform You as soon as possible, and refund or recredit You for any sum that has been paid by You or debited from Your credit card for the Goods.

Delivery

We will arrange to deliver Your order to the address You give when You place Your order. If there is no one at the address given who is competent to accept delivery of the Goods or there is no one available to accept delivery, You will be notified of an alternative delivery date or a place where You can collect the Goods. 

We will use reasonable efforts to deliver Your order as soon as possible after Your order has been accepted, and within 30 days of You placing Your order.

If Your order cannot be delivered to Your address, U K Insurance Limited will inform You as soon as possible, and refund or recredit You for any sum that has been paid by You or debited from Your credit card for delivery.

U K Insurance Limited will not be liable for any loss or damage suffered by You through any reasonable or unavoidable delay in delivery or because We cannot gain access to the delivery address or because of other circumstances beyond Our reasonable control.

We carry the risk of loss or damage to the Goods until We have despatched them.  The Goods will be treated as delivered and the Goods will pass to you on the Date of Delivery. We will not despatch the Goods until you have paid for the Goods in full. If You return the Goods to Us for any reason, they will become Our property and be at Our risk from the time at which We receive them.

Your right of cancellation

You have the right to cancel Your order provided You notify Us within 7 Working Days running from the day after You receive the Goods.

To exercise Your right of cancellation, You must give written notice to U K Insurance Limited by hand or post or email, to the U K Insurance Limited address or email address provided on the Site, giving the purchase order, details of the Goods ordered, and (where appropriate) the date of delivery and We will refund any cleared payment that You have already made. Any additional charges for deliveries outside of the UK will not be refunded or recredited.

You must return any such cancelled Goods within 10 Working Days from the date You cancel the order. The cost of return will be at Your expense. The Goods must be returned to U K Insurance Limited unused, in the original, undamaged packaging along with the sales invoice at the address provided on the Site. Goods will remain Your responsibility until We receive them.

We reserve the right to withhold a percentage of the refund value of returned Goods if the Goods or packaging is in such a condition that the Goods need to be reduced in price for resale.

If You do not return the Goods within 10 Working Days from the date You cancel the order, U K Insurance Limited may charge You a sum for the direct cost of recovering the Goods.

General

U K Insurance Limited may change these Terms without notice to You in relation to future sales.

We cannot guarantee that the appearance and/or colours of the Goods shown on the Site is an exact reproduction of the appearance and/or colours of the physical goods themselves. All sizes quoted are approximate.

If any part of these Terms are found to be unenforceable as a matter of law, all other parts of these Terms shall not be affected and shall remain in force.

U K Insurance Limited's aggregate liability (whether in contract, tort or otherwise) for loss or damage shall in any event be limited to a sum equal to the amount paid or payable by You for the Goods purchased. Nothing in these Terms shall exclude or limit our liability for death, personal injury or fraud.

You may not assign or sub-contract any of Your rights or obligations under these Terms or any related order for Goods to any third party unless agreed upon in writing by U K Insurance Limited.

These Terms and the documents or other sources referred to in these Terms supersede all prior representations, understandings and agreements between You and U K Insurance Limited and sets forth the entire agreement and understanding between You and U K Insurance Limited in relation to Your purchase of Goods on the Site.

U K Insurance Limited reserves the right to transfer, assign, novate or sub-contract the benefit of the whole or part of any of its rights or obligations under these Terms or any related contract to any third party.

The copyright, trade mark and other intellectual property rights in the Churchill Nodding Dog™ are owned by U K Insurance Limited. As proprietor of the trade marks in the Churchill Nodding Dog™, U K insurance Limited has the sole right to use the Churchill Nodding Dog™ for the purposes of its business, including games, play things and toy dogs.

These Terms and any contract for the purchase and sale of Goods shall be governed by the laws of England and any dispute between Us will be resolved exclusively in the Courts of England. English is the only language offered for the conclusion of the contract.

These Terms do not create or confer any rights or benefits enforceable by any person that is not a party within the meaning of the Contracts (Rights of Third Parties) Act 1999.
