AGREEMENT TO PARTICIPATE IN THE CHURCHILL LOLLIPOPPER PROMOTION

  1. The Prize from the Churchill Lollipopper Promotion is available to schools in the United Kingdom.
  2. To Enter: The public will be invited to nominate a school of their choice between 00.01 BST on 12th April 2016 and 23.59 BST on 15th May 2016. All nominated schools will be contacted by the Promoter and all nominated schools must confirm their acceptance to participate (if nominated) by noon on 27th May 2016.
  3. Nominations will only be for schools/ local authorities within one of the following participating regions:
    • South East
    • London
    • North West
    • East of England
    • South West
    • Midlands
    • North East
    • Yorkshire and the Humber
    • Wales
    • Scotland and Northern Ireland
  4. The Prize: Via an independently conducted Prize Draw, 5 schools per region (50 in total) will each win 1x fully funded Lollipopper for one school year from September 2016.
  5. Further Prize Details:
    • The winning schools will receive funding for a Lollipopper up to a maximum of £5,000 (for wages, training and NI) for a one school year contract;
    • The Lollipopper’s contract will be between the winning school and the Lollipopper and should cover the 2016/17 school year from September 2016 with hours to be agreed by mutual consent;
    • The winning schools will be responsible for the costs of advertising and selecting the Lollipopper as well as any background checks and training deemed necessary;
    • At the end of the contract period, the winning schools will be able to decide whether to retain the Lollipopper, at their own expense; and will be responsible for determining their hours, their safety training, uniform, equipment and other related matters;
    • In the event of any job performance or other disciplinary matters, the winning school’s decision is final.
  6. Once a nominated school has accepted their nomination they will be deemed to have accepted these terms and conditions and agree to be bound by them if selected as a Prize winner. If a nominated school does not respond to communication from the Promoter by noon on 27th May 2016 they will be disqualified.
  7. Winner Selection: All valid nominations received by the Promoter during the Promotion Period will be entered into a prize draw to be conducted within 10 working days of the closing date and, for your total confidence, by PromoVeritas, the independent promotional verification service.
  8. Winner Notification: The 50 winning schools will be contacted via email within 15 working days of the draw. In the event a winning school does not respond to communications within 14 days of initial contact, the Promoter reserves the right to disqualify that winning school and allocate the Prize to an alternative winning school selected in the same manner.
  9. The Prize is non-transferable, non-refundable and cannot be exchanged for any cash alternatives in whole or in part. The Prize must be taken as stated and accepted as a whole and no compensation will be payable if the winner is unable to use or accept the prizes as stated.
  10. The Promoter reserves the right to verify the eligibility of all nominated schools. The Promoter may require such information as it considers reasonably necessary for this purpose and a Prize may be withheld unless and until the Promoter is satisfied with the verification.

  12. The Promoter cannot accept any responsibility for any damage, loss or injury suffered by any individual, including the Selected Lollipopper. Nothing shall exclude the Promoter’s liability for death or personal injury as a result of its negligence.
  13. If for any reason the Promotion is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the Promotion.
  14. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation.
  15. The winning schools agree to take part in reasonable publicity arising from the Promotion and the Promoter reserves the right to seek confirmation that the allocated funds have been used for the intended purpose.
  16. The name and region of the winning schools will be available by sending a self - addressed envelope to: Churchill Lollipopper Prize draw, WCRS, 60 Great Portland Street, London, W1W 7RT after 1st May 2016 for 4 weeks.
  17. By entering this Promotion, all participants will be deemed to have accepted and be bound by these terms and conditions.
  18. This Promotion is governed by and construed in accordance with the laws of England and Wales and participants submit to the exclusive jurisdiction of the English courts.

Lollipopper Awards Full Terms and Conditions

  1. This Promotion is open to legal residents of the United Kingdom aged 13 or over. Entrants under the age of 16 will need to obtain consent before they enter this Promotion.
  2. Promotion Period: Enter between 00.01 GMT on 9th November 2016 and 12:00 GMT on 17th November 2016.
  3. No purchase necessary; however, internet access is required.
  4. To Enter: To nominate your favourite Lollipopper in one of the categories below you must:
    a. Go to https://www.churchill.com/lollipoppers;
    b. Pick the Lollipopper’s school, in one of the participating regions (see clause 6), from the drop-down menu;
    c. Enter the name of the Lollipopper (if known);
    d. Choose from one of the four (4) categories that you would like to nominate your chosen Lollipopper for (see clause 5);
    e. Explain why you are nominating them, in no more than 140 characters;
    f. Enter your details: full name and email address;
    g. Press submit to finalise your nomination.
  5. Nominating Categories:
    Categories Description
    Over and Above The Lollipopper who has gone way beyond the call of duty for the crossing/community they serve
    Bravest Lollipopper who has shown extreme bravery whist on the job
    Entertaining The Lollipopper that puts the biggest smile on the children’s faces
    Kindest The Lollipopper who has shown the most kindness to the children and the community they serve

    There will also be a final award given: The 'Lollipop of the Year' Award where a Lollipopper will be selected as the best overall entry from all the four category winners.
  6. Nominations can only be accepted for schools within one of the following participating regions:
    • South East
    • London
    • North West
    • East of England
    • South West
    • Midlands
    • North East
    • Yorkshire and the Humber
    • Wales
    • Scotland and Northern Ireland
  7. The Prize: Four (4) winners will each win:
    a . 1x branded trophy for their category; and
    b. 1x £500 YouTravelCard. For further details see: https://www.yourtravelcard.co.uk.
  8. Entrants may nominate more than one Lollipopper but entrants may only nominate a specific Lollipopper once. Each valid nomination equals one entry into the Promotion and each Lollipopper can receive multiple nominations from different people during the Promotion Period.
  9. All entries into the Promotion are conditional on the agreement of the nominated Lollipopper to participate in the Promotion. Nominated Lollipoppers will be contacted by the Promoter and asked to confirm their agreement to be entered into the Promotion. If a nominated Lollipopper (or school of the Lollipopper) does confirm their agreement to be entered into the Promotion by 17.00 on Tuesday 22nd November 2016, that nominee will be disqualified.
  10. By entering the Promotion, entrants give their permission for their nominations to be used by the Promoter without further compensation, over and above the award of the prize, for up to one year for promotion purposes. Copyright will remain with the entrant. However, by entering this Promotion, the entrant agrees to the Promoter publishing these entries on their website and possible further use on their website, Facebook, Twitter, Instagram or other social media platforms. They also agree to other possible promotional use in media of the Promoter’s choosing without any further payment, over and above the award of the prize, for up to one year but with appropriate credit given to the original entrant.
  11. Winner Selection: All valid nominations received (where the Lollipopper has agreed to participate) by the Promoter during the Promotion Period will be judged by a panel of Judges where one is independent from the Promoter, within 7 days of the end of the Promotion Period and in accordance with the following criteria:
    a. Quantity of nominations received;
    b. Quality of nomination; and
    c. Relevance to the category selected.

    The Promoter’s decision is final and no correspondence will be entered into.

  12. The Promoter reserves the right to reject nominations if they:
    a. contain defamatory, malicious, indecent or other inappropriate content including sexist or racist language or imagery;
    b. include the names, likenesses, photographs or similar of any individual without their express permission;
    c. contain immoral or obscene behaviour;
    d. condone or encourage violent or anti-social behaviour;
    e. cause offence on the grounds of religion, gender, sexual orientation, nudity, disability or age;
    f. refer to any brand other than the Promoter; or
    g. represent a danger, health and safety fear or distress.
  13. 12 shortlisted nominations (3 for each category) will be displayed in wall for fame at https://www.churchill.com/lollipoppers/awards on the 28th November 2016, after the shortlisted finalists have been chosen.
  14. Winner Notification: Winners will be contacted via phone and/or email within 24 hours of the final round of Judging and will be required to respond to confirm acceptance of the prize within 24 hours of initial contact. In the event a winner does not respond to communications within 24 hours of initial contact, the Promoter reserves the right to disqualify that winner and the Prize will be allocated to the next placed nominated Lollipopper.
  15. The winners and shortlisted Lollipoppers will be announced on 29th November 2016 (National Lollipopper Day) on all of Churchill’s social media channels. The winners will be contacted before this date to arrange to take photos and videos of them being awarded their Prize.
  16. By entering this Promotion, the four winners hereby grant the Promoter (or the Promoter’s designee) the exclusive right to film, tape, sound record and photograph all their activities in connection with the Promotion and any prizes. Everything filmed, taped or recorded by the Promoter (or the Promoter’s designee) shall be known as “Footage”. The four winners also hereby irrevocably and unconditionally assign to the Promoter with full title guarantee (and by way of present assignment of present and future rights) all intellectual property rights in any “Footage” throughout the world for the full unexpired period of such rights and all renewals, reversions and extensions of such period as may be provided under any applicable law throughout the world.
  17. The Promoter reserves the right at its absolute discretion to disqualify nominations which it considers do not comply with these terms and conditions or any participant who it reasonably believes has interfered with the fair running of this Promotion.
  18. The Prize is non-transferable, non-refundable and cannot be exchanged for any cash alternatives in whole or in part. The Prize must be taken as stated and accepted and no compensation will be payable if a winner is unable to use or accept the Prize as stated.
  19. All nominations must be made by the nominee themselves. Bulk nominations made from trade, consumer groups or third parties will not be accepted. Incomplete, entries by macros or other automated means (including systems which can be programmed to enter), and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified and will not be counted. If it becomes apparent that an entrant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that entrant’s nominations into the Promotion in a way that is not consistent with the spirit of the Promotion, that entrant’s nominations will be disqualified and any Prize awarded on the basis of the nomination will be void.
  20. No responsibility is accepted for nominations lost, damaged or delayed or as a result of any network, computer hardware or software failure of any kind. Proof of sending will not be accepted as proof of receipt.
